02Purpose

Musiway is a digital application of interactive musical scores, intended for study, performance, accompaniment, and musical interaction, and may include features such as audio playback, markings, annotations, and visual synchronization. Musiway does not replace formal musical education and does not guarantee specific learning results.

03Eligibility

Use of the app is permitted for persons with legal capacity to contract. Minors may only use Musiway with the express authorization of their legal guardians.

04Registration and account

4.1To use certain features, the user must create a personal account.

4.2The user undertakes to provide true, complete, and updated information.

4.3The user is responsible for safeguarding and maintaining the confidentiality of their access credentials.

05Subscription, payments, and billing

5.1Musiway offers functionalities via paid subscription, with recurring billing.

5.2Payments are processed exclusively by the App Store and Google Play platforms, according to their respective rules.

5.3The subscription must be canceled directly in the app store used by the user.

5.4After the start of the subscription usage period, there are no refunds, except when required by local applicable laws.

06Right of withdrawal (European Union)

Users located in the European Union have the right of withdrawal in accordance with current legislation, except when the provision of digital content has begun with the user’s express consent, according to the law.

07Permitted use and prohibitions

7.1The user is allowed to:

• Use the app for personal and non-commercial purposes;
• Access scores according to the limits of the contracted subscription.

7.2It is expressly prohibited to:

• Copy, distribute, sell, share, or reproduce scores without authorization;
• Use the content for commercial purposes;
• Practice reverse engineering or attempt to access the source code;
• Remove copyright notices or trademarks.

08Intellectual property

8.1All content made available on Musiway is protected by copyright and intellectual property laws.

8.2Use of the app does not grant the user any ownership rights over the content.

8.3The Musiway brand, logos, and visual identity belong to DIGA.

09Future features (content upload)

9.1Musiway may, in the future, offer features that allow user content uploads.

9.2DIGA is not obliged to provide such features.

9.3Should this feature be activated, the user declares that they will have all necessary copyrights, exempting DIGA from any liability for infringements.

10Suspension and termination

DIGA may suspend or terminate the user's access in case of:

• Violation of these Terms;
• Improper use of the app;
• Breach of payment rules.

11Limitation of liability

Musiway is provided “as is”, and may experience technical interruptions.
DIGA is not responsible for:

• Technical failures by third parties;
• Data loss caused by external factors;
• Damages arising from improper use of the app.

12Data protection

Musiway is provided “as is”, and may experience technical interruptions.
The processing of personal data is carried out in accordance with Musiway’s Privacy Policy, in compliance with:

• GDPR (European Union – Netherlands and Portugal);
• LGPD (Brazil).

13Applicable law and jurisdiction (variable clause)

These Terms are governed by the laws of the user's country of residence, respecting the mandatory rules of consumer and personal data protection applicable in each jurisdiction.

14Changes to the terms

DIGA may update these Terms at any time.
The current version will always be available in the app.
